Bravo Whisky Golf terms & conditions
1. INTRODUCTION
These Terms & Conditions form a contract between Bravo Whisky Golf Ltd, company number SC 597266, with its registered office address at The Lighthouse, North Berwick EH39 4PX and you as our guest. References to "you", "your" and “guests” in these booking terms means all persons on the booking (including anyone added or substituted at a later date). "We", "us", "our" and “Bravo Whisky Golf” means Bravo Whisky Golf Ltd. A ‘flight plan’ has the same meaning as in the Package Travel and Linked Travel Arrangements Regulations 2018. Where we have organised a package for you, we will refer to ‘our package(s)’; where our supplier has organised a package, we will refer to ‘supplier’s package(s)’.
These terms and conditions shall be governed by and interpreted in accordance with Scots Law and the parties hereto hereby agree to the legal jurisdiction of the Scottish Court.
Although all reasonable efforts have been made to ensure the accuracy of the information (including prices) and images on Bravo Whisky Golf’s site www.bravowhiskygolf.com, on social media channels, brochures, and in promotional material and printed media, changes occasionally occur. Bravo Whisky Golf will therefore confirm the details of your bespoke flight plan (including the price) at the time of booking.
Limitations of Liability
When you contact Bravo Whisky Golf to book your flight plan, you appoint them as an agent to obtain the requested services for you. When you have confirmed the booking and paid a deposit, they will accept responsibility for providing your flight plan from that point onwards. No employee or representative of the Company has the authority to change these conditions or information.
Financial Failure Insurance
In accordance with “The Package Travel, Package Tours Regulations 1992” all passengers booking are insured for the initial deposit and subsequently the balance of all monies paid, including repatriation if required, arising from the cancellation or curtailment of your travel arrangements due to insolvency.
2. PAYMENT TERMS
Planning Fee & Confirmation of Programme
After initial briefings and dialogue with a potential guest Bravo Whisky Golf will issue an invoice for £2,500 per group so that a proposal brochure framework flight plan and price can be prepared. At this planning stage, golf, private charter flights and accommodation will all be researched and provisional bookings secured.
On receipt of the proposal brochure the potential guest will have 10 days to pay a deposit. The £2,500 planning fee will be deducted from the deposit. If a deposit is not paid within 10 days the £2,500 planning fee is non refundable.
Until such time as deposit has been received by Bravo Whisky Golf none of the charter flights, golf, hotel and other arrangements can be confirmed. A finalised and confirmed flight plan, with confirmed charter flights, golf, hotels etc will be issued on receipt of the deposit. Where it is not possible for Bravo Whisky Golf to confirm availability of element(s) of the proposed flight plan at the time of the deposit payment these will be marked as provisional and will be treated as such until availability can be confirmed.
Deposit
Unless otherwise agreed with Bravo Whisky Golf, a non-refundable deposit totalling 40% of the price stated in the proposal brochure will be paid to secure a booking. Payment of the deposit invoice is deemed confirmation of your acceptance of the booking terms and conditions contained in this document. Upon receipt of deposit payment your flight plan is secured from that moment.
Balancing Payment
The balancing payment, 60% of the total cost of the flight plan, is payable 90 days prior to the flight plan start date. If the balancing payment is not received by this date, Bravo Whisky Golf reserves the right to treat your booking as cancelled, and retain your deposit. In which case you could be liable to pay Bravo Whisky cancellation charges of up to 100% of the balancing invoice total based on the commitments made by Bravo Whisky Golf on your behalf. Bookings made less than 90 days before your flight plan start date must be paid in full at the time of booking.
Accepted Forms Of Payment
- Bank Transfer (No surcharge applicable) This is our preferred method.
- Debit Cards or credit cards are also acceptable but may be subject to a surcharge.
3. FLIGHTS
Scheduled
If air tickets are issued by Bravo Whisky Golf for you, these are separate items outside the travel package/ flight plan for which Bravo Whisky Golf are not liable and as such may be subject to changes restrictions and cancellation penalties as specified by the carrier. Scheduled airlines have flight restrictions and it is incumbent on the guest to abide by these restrictions.
Private Charter Flights
For all private charter flights the captain of the aircraft shall have complete discretion concerning the preparation of the aircraft for flight, whether or not a flight shall be undertaken or abandoned. Once undertaken the Captain shall also have sole discretion on any deviation from the proposed route, where landing shall be made and all such other matters relating to the operation and safety of the aircraft and its passengers, all such decisions are final and binding. The Captain and crew reserve the right to search you or your baggage at any time.
Baggage and Weight Restrictions on Private Charter Flights
The Captain of the aircraft shall have absolute discretion to refuse to carry any passengers, baggage or cargo and to decide what load shall be carried and its distribution. Dangerous and illegal items may not be carried on your person or in your baggage. It may be necessary for the Captain to weigh all passengers and luggage before departure, refusal to comply may result in denied boarding. Bravo Whisky Golf will endeavour to give clear guidance in advance of departure as to what your baggage and personal Bravo Whisky Golf weight limits are and how you and your personal luggage/golf equipment are to be transported during your flight plan. It may be necessary at times for your luggage to be transported separately, either by air, road or sea. Bravo Whisky Golf will make all reasonable endeavours to reunite guests with their luggage at the destination hotel at the time window agreed but delays may occur due to circumstances outwith our control (eg cancellation of ferry, etc). Bravo Whisky Golf have contingency plans for most eventualities in these circumstances but as our destination hotels are in remote and challenging locations to reach, guests understanding and flexibility in this respect is appreciated. Bravo Whisky Golf are not liable for loss/theft of baggage/golf clubs whilst on a Bravo Whisky Golf journey and it is recommended that guests obtain appropriate travel or home contents insurance to cover any loss of personal items.
International Shipping Golf Equipment & Luggage
Bravo Whisky Golf may offer to arrange the shipping of your golf equipment/luggage from your home/Club address to the first hotel on your flight plan and if requested by the guest the delivery of clubs home from your last hotel destination as part of your flight plan. This is a supplier contract and Bravo Whisky Golf will not take responsibility for any delays or loss of luggage or equipment.
Passport Details
You are required to ensure that all password details provided to Bravo Whisky Golf, and it’s suppliers, are correct and valid for the duration of your flight plan.
4. CANCELLATION & ALTERATIONS BY YOU
Alterations by You
If you wish to alter any details of your holiday after your deposit invoice has been issued, we will do our best to make the alterations (although we cannot guarantee that such alterations will be possible and we reserve the right to refuse such requests). You must inform Bravo Whisky Golf in writing of your wish to change your flight no later than 2 weeks prior to its start date. Bravo Whisky Golf will not affect any cancellation or amendments until we are notified in writing. In addition, for all alterations a £250 administration fee will be charged per booking together with all costs and charges incurred by us or incurred or imposed by our suppliers (which may be 100% of the cost of the arrangements). Please note: some alterations requested within 2 weeks of departure may be treated as a cancellation and the cancellation charges set out in this clause will apply.
Alterations to a confirmed booking during a flight plan: we regret that no credit or refund is possible for any unused services provided in the cost of your flight plan.
If you decide to alter your travel arrangements during your flight plan this is your own responsibility and we are not responsible for any extras or difficulties that may arise as a result of such alterations.
The quoted price of all flight plans is calculated on the agreed group size stated in the proposal brochure sent to you. The price per person for your flight plan will vary depending on the number of guests booked. Should you wish to change the number of persons booked after the proposal brochure has been issued, the price per person will be recalculated based on the size of the new party. Any additional charges arising from the change in group size will be payable by you within 2 business days
Cancellation by You
In the case of all cancellations, your deposit will not be refunded and in most cases once you have paid the balance payment of the cost of your flight plan, then the following schedule of charges will apply:
Cancellation Between 60-90 days prior to flight plan start date: 50% refund of balancing payment (ie 30 of total cost%) Cancellation Between 0-60 days prior to flight plan start date: there will be NO refund.
(Note: it is unlikely that any of our suppliers will make any refund in the event of a cancellation within 60 days of the booking, although we will pass on any refund or offer that they make.)
If you cancel your holiday after it has commenced, no refund at all will be given. No credit or refund is possible for any lost, mislaid, stolen or destroyed documents which could be the subject of a claim on your own insurance. Note: certain travel arrangements may not be changeable after booking and an alteration request could incur a cancellation charge of up to 100% of that part of the arrangements.
Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy. For this reason Bravo Whisky Golf recommends that you obtain an appropriate travel insurance policy that includes cover for cancellation charges in the event of cancellation due to illness or other circumstances. Claims must be made directly to the insurance company concerned. Please ensure that your insurance policy covers the total cost of your holiday for cancellation purposes. Where any cancellation reduces the number of full paying party members below the number on which the price, number of free places and/or any concessions agreed for your booking were based, we will require payment to cover any shortfall within 2 working days. Your flight plan is a package and if any member of your party is prevented from travelling, that person(s) may transfer their place to someone else (introduced by you and satisfying all the conditions applicable to the arrangements, including an agreement to these booking conditions) providing we are notified in writing not less than seven days before departure and you pay an amendment fee and meet all costs and charges incurred by us and/or incurred or imposed by us or any of our suppliers. Both you and the person to whom you would like to transfer your arrangements shall be jointly and severally liable for the payment of any balance due and for any additional fees, charges or other costs arising from the transfer. If you are unable to find a replacement, cancellation charges as set out below will apply in order to cover our estimated costs. Otherwise, no refunds will be given for passengers not travelling or for unused services.
For a booking to be cancelled in full or part Bravo Whisky Golf requires written confirmation by email to flights@bravowhiskygolf.com and approved by a Company Director.
5. CANCELLATION & ALTERATIONS BY US
Because we plan your arrangements many months in advance, in some circumstances we make changes to them and to cancel them. Most of these changes will be minor and Bravo Whisky Golf will advise you of them at the earliest practicable date. Bravo Whisky Golf reserves the right to make these changes and cancellations at our sole discretion and assumes or accepts no liability for them or their consequences.
Occasionally, we have to make a significant change to your flight plan. A significant change is one where we, or our suppliers, significantly alter any of the main characteristics of your arrangements. If we, or any of our suppliers have to make a significant change or cancel any major element of your flight plan, we will contact you as soon as possible, and if there is time to do so, make alternative plans. If any tour service or its reasonable equivalent is not provided due to events within the reasonable control of Bravo Whisky Golf, the company will attempt to make an appropriate refund of that portion of the flight plan price covering the undelivered service, but it is understood that Bravo Whisky Golf shall have no other or further responsibility or liability either for the accuracy of any representation or the non-provision of any flight plan arrangements beyond that. The size and distribution of any refund(s) remains at the sole discretion of Bravo Whisky Golf. For events outwith the reasonable control of Bravo Whisky Golf see clause 6.
Private Charter Flights
Bravo Whisky Golf does not own or operate any aircraft and acts only as agent, carriage is conditional and subject to our suppliers terms and conditions. These include, but are not limited to; For safety and/or other operational reasons, we have the right in our absolute discretion to do a number of things. We will use all reasonable endeavours to give you at least 24 hours’ notice of any exercise of this discretion, but you accept that this could happen at any time up to the set departure time.
i- We reserve the right to cancel any private charter flight(s) for technical or safety reasons if in the sole opinion of the Captain, continuation of the private charter flights would materially endanger the safety or health of any of the passengers or crew. You will be entitled to reschedule the private charter flight(s) or accept a full or partial refund. ii- We reserve the right to alter and/or divert the private charter flight(s) for technical or safety reasons if in the sole opinion of the Captain, continuation of the private charter flight(s) would materially endanger the safety or health of any of the passengers or crew. In this instance we will endeavour to provide you with alternative transport without undue delay or additional cost.
iii- We reserve the right to cancel the private charter flight(s) if you fail to arrive for them in due time to embark prior to the scheduled departure time and fulfil the agreed itinerary.
Third Party Elements
If Bravo Whisky Golf are forced to alter or cancel a flight plan and these changes affect separate bookings you have made with another supplier then Bravo Whisky Golf are not liable for these third party costs.
6. UNAVOIDABLE AND EXTRAORDINARY CIRCUMSTANCES
Except where otherwise expressly stated in these terms & conditions we will not be liable or give you a price reduction, refund or compensation if our contractual obligations to you are affected by unavoidable and extraordinary circumstances beyond the control of the party who seeks to rely on them which we or the supplier(s) of the service(s) in question could not avoid even if
all reasonable measures had been taken. These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, natural or nuclear disaster, fire, chemical or biological disaster, pandemic and adverse weather, sea, ice and river conditions and all similar events outside our or the supplier(s) concerned’s control. Advice from your government to avoid or leave a particular country may constitute unavoidable and extraordinary circumstances.
7. FLIGHT PLAN PACKAGE EXCLUSIONS & EXTRAS
Lunch, dinner and all drinks (alcoholic and non alcoholic) are not included in the pricing of Bravo Whisky Golf flight plans, breakfast is normally included. Special “signature dinners” and lunches specified in the flight plan brochure will be included and will be specified as such. The invoice for these lunch, dinner and drinks together with any additional expenses incurred must be settled before departure of each individual hotel/residence.
Other elements not included in the flight plan are tips to representatives, coach drivers and local city guides, items of a personal nature, expenses, fees or costs incurred in case of illness, or of refusal of entry, detention in, or expulsion or repatriation from a country or part of a country. Bravo Whisky Golf assume and accept no liability for any expense, costs or loss incurred in relation to such matters.
Hotel Check-In
To guarantee charges for incidental items and extras detailed above hotel suppliers require validation of a current credit card to be supplied by the guest at check in.
8. GOLF RESERVATIONS
Whilst Bravo Whisky Golf endeavours to meet your requests for specific courses, days and times, these are subject to availability and Bravo Whisky Golf cannot guarantee them. Tee times are provided at the sole discretion of our suppliers and may be subject to change.
Tee Times
If you fail to arrive in sufficient time for a tee time you will forfeit your right to play. In special circumstances, such as unavoidable travel delays, alternative tee times will be sought but not guaranteed.
Maintenance
Over seeding and hollow-tining can affect certain courses at certain times. Where possible Bravo Whisky Golf will endeavour to advise you of maintenance in order for any possible alternative arrangements to be made.
Buggies
Bravo Whisky Golf will not pre-book buggies unless they are included in the green fee. Bravo Whisky Golf assumes and accepts no responsibility for the provision or operation of golf buggies.
Caddies
Bravo Whisky Golf cannot be held responsible for pre-booked caddies. Bravo Whisky Golf can only request caddies and therefore cannot guarantee them as in most cases caddies are self-employed. Caddy fees and discretional tips are to be paid directly to the caddy in cash upon completion of your round. Should you prefer not to deal with this financial transaction Bravo Whisky Golf are able to handle this for you by separate arrangement.
Golf Etiquette | Handicap Certificates
Knowledge of golf etiquette and the rules of golf are expected by all members of your group. Increasingly courses are introducing and policing handicap limits. In some circumstances certificates may be required to be produced prior to play. Bravo Whisky Golf strongly recommends you take a handicap certificate with you regardless, we accept no responsibility if you are denied golf for failing to meet the handicap requirements of any given club.
Dress Code
Bravo Whisky Golf cannot accept any responsibility in any ruling by the hotel/golf course if you or any of your group is unable to play due to inappropriate attire. Please check before you travel that your group is aware of appropriate golfing attire.
Golf Tee Times
If unforeseen circumstances beyond our control require Bravo Whisky Golf to make necessary changes to your tee times, Bravo Whisky Golf reserves the right to cancel or reschedule accordingly.
9. OTHER
Complaints
If you have a complaint about your vacation most matters can be resolved as Bravo Whisky Golf escort each flight plan and are always close at hand. If this is not possible please keep a record of events. In the unlikely event matters cannot be resolved to your satisfaction please follow up by emailing flights@bravowhiskygolf.com at the above address within 28 days of your vacation and Bravo Whisky Golf will endeavour to investigate and respond within 7 days of a complaint being received.
Behaviour
Bravo Whisky Golf reserves the right to decline any Company or person as a client or cancel a booking if Bravo Whisky Golf consider their reputation will be compromised. In these circumstances Bravo Whisky Golf will refund payments made by the client at their discretion.
Other Conditions
It is your responsibility to comply with the terms, conditions and requirements of any supplier, or any country or governmental authorities, or to bear any costs or losses incurred as a consequence of you not complying with them.
